The Indochina Project – Terms and Conditions

The Indochina Project (herein referred to to as “The Project” or “Project) is run by the riverorchid group represented by riverorchid orchid Vietnam Co. Ltd., (“owners” or “sponsors”).

The project is free of charge and only subject to the present terms & conditions and to all applicable international, federal, state, local and regional laws and regulations.

By entering and participating in this Project, you agree to be bound by these Terms & Conditions and represent that you satisfy all of the eligibility requirements below.

1. ELIGIBILITY

1.1 In order to enter this Project, you confirm that you ( herein after referred to as “Participant”,“Entrant” or “you”) satisfy the following eligibility criteria:

1.2 You acknowledge that you are 14 years of age or older at the time of participation, and, if under the age of 18 you are participating in this project under active supervision of a parent, legal guardian, or other responsible adult who has read and agreed to these Terms & Conditions on your behalf. Due to the fact that the participation is web-based the project excludes any responsibility and/or liability in case the participation requires the approval or a Guardian. This solely lies within the responsibility of the entrant.

1.3 Please note that the project is not liable in case participants are not legally allowed to take part in the project due to national or local laws.

2. RULES OF PARTICIPATION

2.1 This project starts on 13.05.2013 and ends on 22.06.2013

2.3 The participant has no right to have his/her artwork published whatsoever. The project reserves the right to disqualify Participants and/or remove their artwork from its website as it sees fit, in particular if the quality of the artwork does not conform to the projects standards.

2.4 You will be required to register an account with www.theindochinaproject.com. In order for the registration to be complete you will be required to set up a user profile by inserting your full name and a short description that should focus on your artistic talents. Optionally you will be able to provide us with a link to your website.

2.5 You will be prompted to upload your artwork in the format required. Once the artwork is submitted you will not be able to download it separately or modify it in any way whatsoever.

2.6 All of the data mentioned in 2.4 to 2.5 including the artwork will be made publicly available on the website and might be published via social media and other digital channels by the project.

2.7 In addition, you will be required to enter your valid email address, year of birth, phone number and country of residence. The data mentioned in this section will not be published and will only serve the owner for purposes of this project.

3. GRANT OF RIGHTS

3.1 Notwithstanding clause (3.2) below, the participant acknowledges that all work submitted is their own original creation, and that no other sources have been used, copied, replicated or in any other way plagiarised, be that of other work which is in or out of copyright. The participant further hereby acknowledges that any such violation of copyright or other intellectual property by the participant shall be the sole responsibility of the participant and the Project, sponsors of the Project, and other persons or organisations associated with the Project shall in no way whatsoever be held responsible for any such breaches.

3.2 In the event that any sources of non-original work are incorporated into the work by the participant, they shall be acknowledged appropriately and as required by law. The participant confirms that if any copyright or other intellectual property rights exist on the material, that the participant has obtained requisite approval to use said works, and that responsibility for this shall rest solely and exclusively with the participant.

3.3 The Project and owners of the Project acknowledge that the Project asserts no claims to copyright over work produced by the participant, and that the Project shall not at any time sell to a third party work produced by the participant – for cash or kind – without prior consent of the participant.

3.4 The participant acknowledges that the Project and sponsors of the project, specifically the riverorchid group and its subsidiary companies, including but not limited to riverorchid orchid Vietnam Co. Ltd., shall have the right to use the work of the participant, in whole or in part, at the complete discretion of the Project (and its owners) for purposes of publicising the Project, as well as for inclusion in publicity material for the owners of the project, including, inter alia, credentials presentations, interior decor, website design, brochures, leaflets and magazines etc., so long as under no circumstances is the work of the participant sold for commercial gain pursuant to clause (3.3) above. In any such circumstance of the work of the participant being used, all reasonable and appropriate measures shall be taken by the Project and owners of the Project to ensure that that participant is credited for having produced the work.

3.5 In addition, the artwork provided by the participant might also be shown during the exhibition. This publication will be entirely at the discretion of the project.

4. SELECTION OF WINNING PARTICIPANT

4.1 The selected winning participant will be announced on 10.06.2013. This selection will be entirely at the discretion of the project. No correspondence on winner selection shall be entered into.

4.2 The project will cover costs of return economy flights for the selected participant to travel from their stated country of residence to Ho Chi Minh City, Vietnam, and provide two nights accommodation in a 3 star hotel in Ho Chi Minh City , Vietnam, during the period of 21.06.2013 to 23.06.2013. The selection of airline, flights, and hotel will be entirely at the discretion of the project and all bookings must be approved by the project before confirmation or payment is made.

4.3  Should the winning participant come for outside Vietnam, it will be the responsibility of the participant to ensure he/she has necessary travel documents including passport and visa if applicable.

4.4 The selected winning participant will be expected to create their artwork live at an event in Ho Chi Minh City on 22.06.2012 from 12pm-10pm. The selected participant will also be expected to be present for installation on 21.06.2013.

4.5 The project will supply materials suitable for the creation of the selected participants artwork. The selection of said materials will be entirely at the discretion of the project.

5. LIABILITY AND WARRANTY

5.1 The Project and sponsors exclude all liability to you for any loss of income, loss of profits, loss of goodwill, loss of data, loss of opportunity and any indirect or consequential loss or damages incurred or suffered to you in connection with your participation in the project.

5.2 To the fullest extent permissible by law, no conditions, warranties or other terms apply to the project.

5.3 These terms are written in English and governed by the law of the Social Republic of Vietnam.
